The Court of Appeal on Wednesday sealed the faith of the suspended Chief Justice of Nigeria (CJN), Walter Onnoghen over his pending trial at the Code of Conduct Tribunal (CCT).
The appellate court had dismissed the motion filed by Onnoghen, seeking for a stay of action in his trial at the CCT.
Onnoghen on Tuesday filed a suit against the federal government over his suspension.
It was on the day the National Judicial Council queried both Onnoghen and the acting CJN, Tanko Mohammed over the matters affecting them.
The NJC gave them seven days to reply to their queries. Onnoghen was to explain his role in the asset declaration while Mohammed is to explain why he accepted the position of the CJN without the approval of the NJC.
Onnoghen in his appeal to the Court of Appeal said he was not given a fair hearing by the CCT before the order to swear-in Muhammad was issued.
He is also questioning the powers of the CCT to try him.
